A webinar on the topic of “Basic Considerations on How to Set up a Club System (Uniform Marketing System)”

In the framework of the training seminars of CIOPORA (International Community of Breeders of Asexually Reproduced Horticultural Plant Varieties) a webinar on the topic of “Basic Considerations on How to Set up a Club System (Uniform Marketing System)” was held on July 02 this year.

This is extremely topical issue for breeders and rather complicated business topic. The webinar covered the problems of creating a uniform marketing system for the chain starting from creation of a plant variety to sale of planting material and/or fruits (harvest); the benefits of combining various types of intellectual property rights not only for breeders, but also for manufacturers, as well as for end users.

The participants considered the contract systems, their peculiarities and risks for each stage (link) of a uniform marketing system. In particular, important issues such as the components of a contract with the author of the variety, the boundaries of a license agreement (beyond the scope of the IP), the moment when the rights to the variety arise and the stages for transfer of rights (Nemo dat quod non habet principle) were analyzed, practical recommendations on how not to “lose” the novelty of the variety in the process of its testing were received and other legally important aspects were considered.
